Overview

Coco Studios ("we", "us", or "our") developed the DuckRemote application ("the App"). By downloading, installing, or using the App, you ("you" or "the user") agree to be bound by these Terms and Conditions. If you do not agree, please do not download or use the App.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction, such as 16 in parts of the European Union) to download or use the App. By using the App, you represent that you meet this age requirement.

2. Use of the App

The App enables controlling smart TVs and streaming devices (including Android TV, Google TV, Chromecast, Samsung, LG, Roku, and Amazon Fire TV) from your mobile phone over a local Wi-Fi network. You agree to use the App only for lawful purposes and for its intended functionality.

3. License

Subject to your compliance with these Terms, Coco Studios grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App for personal, non-commercial use on devices that you own or control.

4. Restrictions

You agree not to:

• Modify, reverse engineer, decompile, or disassemble the App
• Copy, distribute, sell, sublicense, or create derivative works of the App
• Use the App for any unlawful or unauthorized purpose
• Attempt to gain unauthorized access to any system, network, or device through the App
• Remove or alter any copyright, trademark, or other proprietary notices in the App

5. Free App with Optional Ad-Removal Subscription

The App's full functionality is available free of charge and is supported by advertising (see Section 8). All remote-control features are included in the free version.

For users who prefer an ad-free experience, the App offers an optional auto-renewable subscription ("Ad-Free Subscription") that removes advertisements.

Subscription terms:

• Subscription periods: Weekly and monthly options are offered.
• Pricing: Prices are displayed in the App at the time of purchase and may vary by country, region, and currency. We reserve the right to change prices, with notice as required by the App Store, Google Play Store, and applicable law.
• Payment: Payment is charged to your Apple ID account (iOS) or your Google Play account (Android) at confirmation of purchase.
• Auto-renewal: The subscription automatically renews at the end of each billing period unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current price.
• Managing & cancelling: You can manage your subscription and turn off auto-renewal at any time:
  • iOS: Settings → [your name] → Subscriptions
  • Android: Google Play Store → Profile → Payments & subscriptions → Subscriptions
• Cancellation effect: Cancelling stops future renewals. You will continue to enjoy ad-free access until the end of the current paid period. We do not provide refunds for unused portions of the subscription period, except where required by applicable law.
• Refunds: Refund requests are handled by Apple (iOS) or Google (Android) under their respective refund policies. Coco Studios does not process payments or refunds directly.

For iOS users: by subscribing, you also agree to Apple's Standard Terms of Service (EULA).

6. Intellectual Property

The App and all its content, features, and functionality — including but not limited to text, graphics, logos, icons, images, and software — are the exclusive property of Coco Studios and are protected by copyright, trademark, and other intellectual property laws. All trademarks of third-party manufacturers (Google, Samsung, LG, Roku, Amazon, etc.) referenced in the App belong to their respective owners and are used solely to describe device compatibility.

7. Third-Party Services

The App integrates third-party services including Firebase (Google), Google AdMob, Google Play Services, and Apple services. Your use of these services is also governed by their respective terms and privacy policies. Coco Studios is not responsible for the practices, content, or terms of any third-party service.

8. Advertisements

Unless you have an active Ad-Free Subscription (see Section 5), the App displays advertisements provided by Google AdMob. On iOS, advertisement personalization requires your explicit consent via Apple's App Tracking Transparency prompt. If you decline, you will still see ads, but they will be non-personalized. 9. Apple App Store Additional Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

• These Terms are an agreement between you and Coco Studios only, and not with Apple Inc. ("Apple"). Coco Studios — not Apple — is solely responsible for the App and its content.
• Apple has no obligation to provide any maintenance or support services for the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App.
• Coco Studios, not Apple, is responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
• In the event of any third-party claim that the App or your use of it infringes that third party's intellectual property rights, Coco Studios — not Apple — will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
• You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and (ii) you are not on any U.S. Government list of prohibited or restricted parties.
• You must comply with applicable third-party terms of agreement when using the App (for example, your wireless data service agreement).
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
• The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions.

10. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Coco Studios does not guarantee that the App will be uninterrupted, error-free, secure, or compatible with all devices, networks, or operating systems.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Coco Studios shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of, or inability to use, the App. In any event, Coco Studios' total cumulative liability to you shall not exceed the amount you paid for the App, which is zero (USD $0). Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

12. Indemnification

You agree to indemnify and hold harmless Coco Studios from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the App or your violation of these Terms.

13. Termination

Coco Studios may suspend or terminate your access to the App at any time, without notice, for any reason, including breach of these Terms. You may stop using the App at any time by uninstalling it from your device.

14. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. For material changes, we will provide reasonable notice through the App or our website. Your continued use of the App after such changes take effect constitutes your acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the country in which you reside, without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of the App shall be subject to the jurisdiction of the courts of your country of residence. Nothing in this section limits any non-waivable consumer rights you may have under your local law.
